Why HITA Sued the Arizona Attorney General’s Office — and What’s at Stake for the Hemp Industry
At the Hemp Industry Trade Association of Arizona (HITA), we have spent nearly a decade building a compliant, sustainable, and innovative hemp industry in our state. We’ve worked hand in hand with lawmakers, regulators, and entrepreneurs to ensure that Arizona farmers and small businesses can thrive in this emerging sector.
But now, our very industry is under threat—not from bad actors or economic headwinds, but from government overreach.
Why We Filed a Lawsuit Against the Arizona Attorney General’s Office
On behalf of our members and the thousands of Arizonans who depend on hemp for their livelihood, HITA has filed a lawsuit against the Arizona Attorney General’s Office.
At issue is a misinterpretation and unlawful enforcement of hemp laws that contradict both federal standards and Arizona’s own legislation. The actions of the Attorney General’s Office has created confusion, fear, and unwarranted disruption, targeting legal businesses and putting honest operators at risk.
Let us be very clear:
We are not defending loopholes or shady practices.
We are defending the law as it was written—and the people who followed it.
What We’re Asking the Court: A Temporary Restraining Order (TRO)
As part of our legal filing, we are requesting a Temporary Restraining Order (TRO) to immediately halt the AG’s overreach and prevent further harm to Arizona hemp businesses while the courts consider the case.
Without swift intervention, jobs will be lost, crops will go to waste, and Arizona will send a dangerous message to entrepreneurs across the Arizona: that obeying the law may still get you punished.
